Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legal agreement between you ("Client," "you," or "your") and Chosen Journey Therapy Group ("we," "us," "our," or "Provider"). By accessing our website, scheduling an appointment, or using our mental health services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable federal, state, and local laws and regulations.
If you do not agree with any part of these Terms, you must not use our services. Your continued use of our services following any changes to these Terms constitutes acceptance of those changes.
2. Services Provided
Chosen Journey Therapy Group provides professional mental health counseling and psychotherapy services through licensed mental health professionals, including Licensed Clinical Social Workers (LCSW). Our services include, but are not limited to, individual therapy, couples therapy, family therapy, and related mental health treatment services.
All services are provided in accordance with applicable professional standards, ethical guidelines, and state licensing requirements. Services may be delivered in-person at our office location or via secure telehealth platforms, subject to licensure and clinical appropriateness.
3. Professional Relationship
The relationship between you and your therapist is a professional therapeutic relationship. This is not a social or personal relationship. Communication outside of scheduled appointments should be limited to administrative matters such as scheduling or billing questions. Therapists cannot provide crisis intervention or emergency services via email, text, or phone calls outside of scheduled sessions.
Dual relationships (such as business, social, or personal relationships outside of therapy) can compromise the therapeutic relationship and are generally prohibited by professional ethical standards.
4. Client Responsibilities
4.1 Attendance and Punctuality
Clients are expected to arrive on time for all scheduled appointments. Late arrivals may result in shortened sessions, as appointments cannot extend beyond the scheduled time due to subsequent appointments. Clients are responsible for providing at least 24 hours advance notice for cancellations or rescheduling requests.
4.2 Payment Obligations
Payment for services is due at the time of service unless alternative payment arrangements have been made in advance and approved in writing. Clients are required to maintain a valid credit card or payment method on file. Clients must immediately notify us of any changes to insurance coverage, billing information, or if they experience financial hardship that may affect their ability to pay for services.
4.3 Honesty and Cooperation
Therapeutic success depends on open and honest communication. Clients are responsible for providing accurate and complete information during the intake process and throughout treatment, including disclosure of symptoms, medical history, current medications, substance use, and other treatments being received. Clients should communicate openly about treatment goals, concerns, and any issues that arise during therapy.
4.4 Compliance with Treatment
While participation in therapy is voluntary, clients are encouraged to actively engage in the therapeutic process, complete any recommended homework or exercises, and follow through with any referrals to other healthcare providers when clinically indicated.
5. Appointment Policies
5.1 Scheduling and Rescheduling
Appointments may be scheduled through our website, by phone, or via email. We will make reasonable efforts to accommodate your preferred appointment times, subject to availability.
5.2 Cancellation Policy
We require at least 24 hours advance notice to cancel or reschedule an appointment. Cancellation requests must be submitted through our website, by phone, or by email. Cancellations made with less than 24 hours notice (late cancellations) may be subject to a cancellation fee of up to the full session rate.
5.3 No-Show Policy
Failure to attend a scheduled appointment without any prior notice (no-show) will result in a charge equal to the full session fee. No-show fees are not covered by insurance and are the client's responsibility.
5.4 Exceptions and Emergencies
We understand that genuine emergencies and unforeseen circumstances occur. We will consider exceptions to our cancellation and no-show policies on a case-by-case basis for circumstances truly beyond your control, such as medical emergencies, severe weather, or other documented emergencies.
5.5 Repeated Cancellations or No-Shows
A pattern of repeated late cancellations or no-shows may result in termination of the therapeutic relationship, as consistent attendance is essential for effective treatment.
6. Fees and Payment
6.1 Session Fees
Our current fees for services are available upon request and will be discussed during the intake process. Fees are subject to change with 30 days written notice.
6.2 Insurance
If you are using insurance, you are responsible for understanding your insurance benefits, including deductibles, copayments, and coinsurance. We will bill your insurance company as a courtesy, but you remain responsible for any amounts not covered by insurance, including deductibles, copayments, and services that are not covered benefits.
6.3 Outstanding Balances
Unpaid balances are due within 30 days of billing. Accounts with balances overdue by more than 60 days may be referred to a collection agency. You will be responsible for all costs associated with collection, including collection agency fees and reasonable attorney fees. Services may be suspended or terminated for non-payment.
7. Confidentiality and Privacy
All information shared during therapy sessions is confidential and protected by state and federal laws, including the Health Insurance Portability and Accountability Act (HIPAA) and applicable state mental health confidentiality laws. However, there are specific legal and ethical situations where confidentiality may be limited or breached:
Mandatory Reporting: Therapists are required by law to report suspected abuse or neglect of children, elderly persons, or disabled persons to appropriate authorities.
Danger to Self or Others: If a therapist believes you pose an imminent risk of serious harm to yourself or others, confidentiality may be breached to prevent such harm, including involuntary hospitalization or notification of law enforcement.
Court Orders: Confidential information may be disclosed pursuant to a valid court order or subpoena, though we will assert privilege and confidentiality protections to the fullest extent permitted by law.
Your Authorization: Information may be shared with your written authorization to other healthcare providers, family members, or third parties as you specify.

8. Emergency Situations
This practice does not provide 24/7 crisis intervention or emergency services. If you are experiencing a mental health emergency, life-threatening situation, or are in immediate danger, you should:
Call 911 immediately for emergency assistance; go to your nearest hospital emergency room; call the National Suicide Prevention Lifeline at 988 (available 24/7); text "HELLO" to 741741 to reach the Crisis Text Line (available 24/7); or contact the SAMHSA National Helpline at 1-800-662-4357.
Therapists may not be immediately available to respond to calls, texts, or emails between sessions. Communication between sessions should be limited to brief administrative matters. Do not use email, text, or voicemail for urgent clinical matters.
9. Telehealth Services
9.1 Consent to Telehealth
By participating in telehealth services, you consent to receiving mental health services via secure video conferencing technology. Telehealth services are subject to the same professional standards and confidentiality protections as in-person services.
9.2 Technology Requirements and Responsibilities
You are responsible for having a reliable internet connection, appropriate device (computer, tablet, or smartphone), and a private, quiet location for virtual sessions. You must test technology before your first telehealth appointment and immediately report any technical difficulties.
9.3 Telehealth Limitations and Risks
You acknowledge and accept the following risks and limitations of telehealth: technology failures or interruptions may occur; video and audio quality may vary; there are potential privacy risks associated with electronic communications; telehealth may not be appropriate for all clinical presentations, particularly crisis situations; and in-person services may be more effective for certain conditions.
9.4 Licensure and Location
Our therapists are licensed to practice in the State of Florida only. By participating in telehealth sessions, you confirm that you are physically located in Florida at the time of each session. Services cannot be provided to clients located outside of Florida.
10. Termination of Services
10.1 Client-Initiated Termination
You have the right to terminate therapy at any time for any reason. We strongly encourage you to discuss your decision with your therapist to ensure appropriate closure and, if needed, obtain referrals to other mental health providers.
10.2 Provider-Initiated Termination
We reserve the right to terminate the therapeutic relationship under the following circumstances: treatment goals have been substantially achieved; you would benefit more from a different type of treatment, different theoretical approach, or a different provider; there has been a pattern of repeated missed appointments or late cancellations; there is non-payment for services rendered; the therapeutic relationship has become clinically ineffective or counterproductive; you engage in threatening, abusive, or inappropriate behavior toward staff or therapist; or there exists a conflict of interest or dual relationship that compromises professional boundaries.
In the event of provider-initiated termination, we will provide you with appropriate referrals to other mental health professionals or resources, and will make your clinical records available to your new provider with your written authorization.
11. Limitation of Liability and Disclaimers
While we are committed to providing high-quality professional mental health services, we cannot guarantee specific outcomes or results from therapy. Mental health treatment is a collaborative process, and outcomes depend on many factors, including client engagement and external life circumstances.
To the fullest extent permitted by law, Chosen Journey Therapy Group, its owners, therapists, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to lost profits, loss of data, emotional distress, or personal injury, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of these Terms or our services shall not exceed the amount you paid for services during the six months preceding the claim.
12. Website Use and Account Security
12.1 Account Registration
If you create an account on our website, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your username and password, and for all activities that occur under your account.
12.2 Prohibited Conduct
You agree not to: use our website for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to our systems or other users' accounts; transmit viruses, malware, or other harmful code; interfere with or disrupt the integrity or performance of the website; impersonate any person or entity; collect or harvest personal information about other users; or use automated systems (bots, scrapers) to access the website.
12.3 Account Termination
We reserve the right to suspend or terminate your account and access to our website at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
13. Intellectual Property Rights
All content on this website, including but not limited to text, graphics, logos, images, videos, software, and the compilation thereof (collectively, "Content"), is the property of Chosen Journey Therapy Group or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from our website without our prior written consent, except for your personal, non-commercial use.
14. Indemnification
You agree to indemnify, defend, and hold harmless Chosen Journey Therapy Group, its owners, therapists, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: your use of our services or website; your violation of these Terms; your violation of any rights of another party; or your violation of any applicable law or regulation.
15. Dispute Resolution and Governing Law
15.1 Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
15.2 Jurisdiction and Venue
Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
15.3 Informal Dispute Resolution
Before filing any legal action, you agree to first attempt to resolve any dispute informally by contacting us at hello@chosenjtg.com and providing a detailed description of the dispute. We will attempt to resolve the dispute informally within 30 days.
16. Changes to Terms of Service
We reserve the right to modify, amend, or update these Terms of Service at any time at our sole discretion. When we make material changes, we will post the updated Terms on this page and update the "Effective Date" at the top of the page. We may also notify you via email or through a notice on our website.
Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of our services.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
18. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
19. Assignment
You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder to any third party without notice or your consent.
20. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other written agreements between you and Chosen Journey Therapy Group, constitute the entire agreement between you and us regarding the use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
21. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
